I know a lot of July 2nd filers and some other who have been waiting for receipt notices...
There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....
So everybody who is frustrated ..hang in there..have patience

10/11/2007: July VB Fiasco I-485 Receipting Delays
The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

I think there is a rule, heard from a student who was advised by the International Student Advisor. They should be the most reliable source of this information.

My brother graduated in Dec 08 and is on OPT now. He is with a consultant and he was wondering if there is any rule which states that folks on OPT should get a job in 3 months, otherwise the OPT will not be valid.
Can any one please clarify.

Hi,
Company B has applied for I-140 and 485 because you will work with them for a min of 6 to 12 months after getting GC.
So its not required for you to join them if they have already submitted I-140 and 485. You can say that you will join them after getting GC.
And if the 485 takes more than 180 days for the approval from the receipt date you can apply the AC21 portability rule and submit a new employment offer from anycompany and you can join that company.(Provided I-140 is approved and if I-140 is pending for more than 180 days then you can port the I-140 priority date by restarting the whole GC process)
Above is the knowledge I got from IV and google.
So u dont need to worry and join the company B, but keep them happy since they have to respond to all RFE till I-140 is approved.

My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.

Other gurus can answer in a detailed manner. I am going to very short. Chinese Eb3 have filed for an injunction stating that they need to be allocated visa numbers because in 2008 and 2009 they were overlooked because DOS could not count the inventory of EB3 properly.
DOS replied that this kind of injunction would harm other countries ppl. DOS is allowed by law to make reasonable estimates in progressing and degressing priority dates. If some ppl are left behind they cannot do anything.
Here is the part of the law which states that DOS has the authority to do reasonable estimates of priority dates and this is what was stated in the DOS response to the injunction
Congress has expressly
provided that in allocating visa numbers, the Department of State may “make reasonable
estimates.” 8 U.S.C. � 1153(g). In relevant part, Section 1153(g) states:
For purposes of carrying out the Secretary’s responsibilities in the orderly administration
of this section, the Secretary may make reasonable estimates of the anticipated number of
visas to be issued during any quarter of any fiscal year . . . and to rely upon such estimates
in authorizing the issuances of visas.

Does anybody have idea or experience how long it takes for USCIS to make desicion about I-485 expedition (pending for 2.8 years now)?
My hospital sent expedition request to TSC about 3 months ago, there is no replay yet.
I'll appreciate any advice/information.
It takes forever unless you file a lawsuit.

Barring the obvious differences like the larger viewfinder & LCD screen which are good and the frustrating differences such as not being able to re use the batteries from the D70 along with the switch to the SD card. The pleasant surprise comes when setting down to do a post edit after shooting and seeing the improved image quality. The first thing I noticed was the greater detail in the eyes. I've uploaded two images cropped and untouched taken straight from the camera. Both were shot under similar conditions, overcast day, both in a wooded area with trees overhead and a fill flash used in both. The first image is from the D70 and the second is from the D80. This very well could be a battle of the lenses as well, 70-300mm vs the 18-200mm, both Nikkor. Regardless of which is responsible for the improvements I like what I see.

How do you know that your case has been transferred from NSC to TSC.
Receipt has address of issuing office at the bottom of it. I also had nothing showing up in the system until yesterday, but today, our EAD's are in the system, but not I-485 or I-131. Perhaps EAD is considered a priority.

Sir,
I got my green card on Feb'2008 and had to make emergency travel to my country Mexico to be with my family on August'2008. Now, I would like to come back after 10 months of stay in Mexico. The problem is that I do not have any permanent residence/car/Electricity bill to prove my permanent residency status except VOIP phone and paid my tax for the last 6 years promptly. Is it possible for me to make it to USA? or Should I wait for 2 more moths and file for Visa reentry permit in local embassy and come there if I get one?
Please advice me.

Any word on when PP for I-140 will come to life?
USCIS said PP is suspended till 8/1 and later will analyze the situation to bring it back. The analysis is talking more than a month. It is known that they have been busy people this past month. Is the I-140 application flood effecting their analysis?

This law only applies to H1-B filing fees paid to USCIS. Your employer is still legally allowed to collect any attorney fees for filing your petition from you.
