Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

My friend is filing for student visa(for masters) as her H1B is about to expire in september(already has 6 years on it). She has worked on different projects and even had part-time jobs but she couldnt find a company that can sponsor her H1b. She was also jobless for an year(last)...long story.....anyways.. She lives with her family but her parents cannot help her much cuz their green card application is still in process but she is above 35 yrs old. Now she cannot think of how to answer these questions on F1-Visa.
-Describe the events that led to your decision to study in the U.S.
�Describe your intention concerning departure from the U.S.
�Show evidence that establishes that you have a residence abroad to which you intend to return
She is from Pakistan and althu she has relatives there and plus her parents own a house(proof of her resident in PK that she can return to) too but you know how the situation is there and she wants to live with her parents. So how should she answer the above questions?

But just make sure your parents carry a document that has details about your name, ssn, address, job, etc.
In case the office asks where they are going to stay, etc. They might know all this, but will be helpful to have on paper too.
Other than that, nothing is required, just their passports and visas.
Dont forget to get medical insurance. Ofcourse its not mandatory.

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?

"CIS electronic records indicate that both applicants have current Fingerprint results and FBI name checks"

e-file your i-140, then you have 7 business days to send in your supporting documents (receipt notice is generated immediately from your printer). I-485 can be filed before August 17
I have read somewhere that e-filed 140s are processed by TSC [which is a good thing for me because I have heard that TSC is lenient with cases like mine - 3 year degree ]

i submitted my 485 one month ago but still haven't got receipt. I just got a new job offer from a big company, which i really dont want to reject. if i transfer my h1b now, will be 485 get rejected immediately? or my h1b transfer will be rejected? thanks for your advice!

- Communication: Improved one-to-one communication rather than hunting for information in forums. Perhaps even a newsletter updating you on what's going on, what's being planned, what are the activities.. and action items.
- Funding: Sustainable funding for lobbying efforts, media relations, etc.
- Live Nag-Free! No one asks you what you've contributed in every second post, you don't have to wear the ID tag of your contribution amount around your neck to prevent such questions
- Community: Be part of a community with a national presence, with local chapters.
- Legal advice: Get free legal advice in monthly/quarterly/periodic conf calls/webinars
- Jobs: Job postings or referrals on IV members-only site
- Business opportunities: Come together with other IV members to explore common business opportunities
- Myriad other benefits that memberships in professional organizations come with, such as travel discounts for instance.

Hello,
You can not (lawfully) re-enter on an H1B, as you're out of status. If you get caught lying at the border, you will be turned back and will likely be permanently barred from entering the U.S. You'll want to re-enter on an H4 visa - you dont need an H4 petition, although obviously you'll need to qualify for the H4, so be prepared to document your spouse's H1 approval and valid status.
Are you stating that you were laid off (thus overstaying), or that you were benched without pay (meaning your employer should have been paying you)? With more than 90 days out-of-status, you may have triggered a period of ineligibility to re-enter the U.S.
Given the apparent overstay issue, I suggest consulting an immigration lawyer.
