Dear Fellas,
I went for H1b Stamping a couple of months back. I was given a 221 g at that time and later on was asked for company's tax documents. During this time I did not hear any thing from US embassy in islamabad and got the same reply that my case was under administrative processing.
yesterday I received a letter from US embassy saying that my petition was returned to INS. The whole process has been very frustrating and I even left a couple of good offers hoping that H1b will get through anyways I guess its over for me now......
Did any one else face the same situation?? Will it do any good to reapply?

Sorry to hear about it. Don't get discouraged though, you will find new offers soon, just keep trying. Remember that persistence creates luck. About the reapplying for visa, I guess you should first talk to your company about it and then with the lawyers who helped prepare the documents. I guess, that'd be good place to start with. In the mean time, keep an eye on the opportunities in your home country. Good luck.

Middlesex County Superior Court Judge James Hurley ordered firms that register domains and provide hosting services -- GoDaddy Inc., Network Solutions, Comcast Cable Communications Inc. and DiscountASP.Net, to disable the three sites, ITgrunt.com, Endh1b.com, and Guestworkerfraud.com. Facebook Inc. was also ordered to disable ITgrunt's Facebook page.
The order was made in response to a libel lawsuit filed by IT services and consulting firm Apex Technology Group Inc., based in Edison, N.J. against the three Web sites opposing the H-1B visa program (http://www.h1b.biz/lawyer-attorney-1137085.html). Such attacks on H1B supporters increased last year as the economic situation was gloomy, and prospects for employment were not looking good. Yet, we all know that the H1B program is not the cause of all evil and in fact is a boosting factor in creation of new jobs and opportunities for American workers. It depends on your Service Center. For TSC, you can have your EAD after 11 weeks from Receipt. For NSC, you can have your EAD after 12 to 14 weeks from Receipt.

I am trying to find health insurance for my spouse who is in H4 visa.
Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
BTW, I am living in NJ.

My 6 years on H1b expires on Nov 2010. I have 140 approved from company A.
1.What's the earliest I can apply for 3 year H1b extension based on my 140 approval?
2. If I switch to company B right now and get company B to file for labor using my approved labor's priority date, are there any time restrictions for filing H1b extension?
3. Suppose I get a 3 yr H1b extension from company A, can i switch to different company after that using that H1b visa?
Any feedback is welcome. Thanks.

The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.

Thanks for that link. It is good to know that there is a possibility that I-140 PP may come back in the near future, even if in phases.
One comforting factor here is the extra $1000 is big money for no extra work which is very tempting to USCIS. So everyone knew they would bring it back as soon as the load became manageable, but the big question was when would the load become manageable.

Friends, my 140 was filed in late July 07 and it is at TSC. Going by the timeline posted on their site, I am likely to hear from TSC by late Jan 08 (i.e., six months after July 07). Any recent experiences about whether the online status changes on time or you first get the approval/RFE/rejection physically and then online status reflects the status afterwards?

If you filed for I-485 for your son as well then he is in Adjustment of Status (AOS), otherwise he may be out of status once you start using your EAD. Talk to an attorney if you have not filed for AOS for your son and plan to use EAD.

My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July.

Provided that the H-1B extension was filed before the prior H-1B status expired, you can stay in the US and work for that employer while the extension is pending.

It is a good opportunity for state chapters. Unfortunately not many state chapters are yet formed despite having 8000+ members. We have members from every state but only a handful state members are actively working. Unless we all ourselves take responsibility and actively organize and participate in state chapters it is tough to use the grassroots level strength of this organization. We have more than a thousand members coming everyday to this site and posting ideas, opinions and what IV should do and what IV should not do. We all can achieve everything easily if everyone actively makes their state chapters alive and participate. If you feel that there is nobody in your chapter, then take a lead role and organize it. If you find that few members have signed up, and nothing is happening, then PM all those that are signed up and start working on action items.

The first picture isn't as good as the others, because it's too dark in the face. You need to wait for the light to hit their face some, and then snap. Harder to do, than to recommend, really.

1. No - nothing about canadian PR is required, only country of citizenship

3. I dont know what LOE is - already having a canadian PR doesnt affect 485 (we've done the same) - you cannot maintain PR of 2 countries at the same time
